The company registration procedure of a yacht charter business in Singapore is the same as other businesses.

Below is the summary of company incorporation process in Singapore: a.) Decide the business structure

  • Sole-Proprietorship
  • Partnership

b.) Name your business

Of course, your yacht charter business needs a business name. Before you register it with Accounting and Corporate Regulatory Authority (“ACRA”) , please make sure that you run a name check (to rule out the possibility of duplication of company name and to determine the availability of the name).

c.) Incorporate your business

i.) Checklist – before the incorporation:

  • you have at least one shareholder in your company
  • you have at least one local company director (the local director can be either a Singapore citizen, or a Permanent Resident, or a person holding an EntrePass, Employment Pass, or Dependent Pass)
  • the appointed Company Secretary is a Singapore’s resident.
  • Your company has a minimum of S$1 of paid-up capital
  • Your company has a local address as the registered company address

ii.) Documents needed by ACRA (for company registration)

  • ACRA-approved company name
  • Brief description of business activities
  • Details of shareholder(s)
  • Details of director(s)
  • Details of company secretary
  • Registered Address
  • Company Constitution

iii.) Company registration process

  • Singapore’s company registration process is fully computerized by ACRA.
  • A company needs only two days to complete its incorporation process.

Licenses for yacht charter businesses in Singapore

While Singapore does not issue any special licenses related to the activity of the yacht charter company (other than the business license issued by ACRA), the vessels to be chartered have to be registered with the Ship Registry . If the yacht’s owner is a foreign citizen with a Singapore residence permit, or a company with a registered seat in this country, he or she must possess an employment or residence pass.

  • Submit an application to reserve the name of the boat;
  • apply for an official number
  • apply for a call sign or a signal letter;
  • submit relevant documents related to the vessel registration;
  • pay the registration fees;
  • pay the annual tonnage tax

b.) Documents needed in vessel registration in Singapore

  • Details or information about the ship’s owner: identification papers (in the case of natural persons) and the business profile of the company(in the case of legal entities);
  • a copy of the Bill of Sale or the Builder’s Certificate;
  • a declaration with the value of the vessel is clearly stated;
  • a tonnage certificate;
  • a class certificate.

Registration of Pleasure Craft

The MPA service counter at mTower, Level 21 will be closed until further notice. There will be no changes to our operating hours i.e. Monday to Friday from 8.30am to 5.30pm. All submission and collection of Registry-related documents will continue to be carried out by post, designated drop-off box and multi-trays. Purpose of the Register

Pleasure craft registered with the Singapore Registry is to be used exclusively by the owner, or guest of the owner, for sport or pleasure purposes only, and may not be deployed for commercial purposes or reward. If the craft is solely operating within Singapore waters, SZ-licensed suffice. A flag registry is not required.

New Requirements with Effect from 1 July 2020 

A new set of regulations, Merchant Shipping (Pleasure Craft) Regulations 2020, will come into effect  1 July 2020  which stipulates the requirements for registration of pleasure craft.  This requirement only affects the Singapore-registered pleasure craft.  The enhancements include expansion of registration conditions and implementation of safety requirements. These will be enforced under the  new regulations. To provide an overview of the key requirements under the new regulations, you may refer to:

Eligibility for Registration

Singapore-registered pleasure craft can be owned by a person who is ordinarily resident in Singapore or a Singapore business entity (whether for profit or not)  such as a body  corporate, a firm, partnership or associations.

New Conditions of Registration

With effect from 1 July 2020, the pleasure craft must comply with the new conditions of registration. Pleasure craft that do not meet the criteria in particular length and construction material will not be renewed or renewed but with conditions.

  • The pleasure craft must be at least 7 metres in load line length with an enclosed deck;
  • The pleasure craft must not be more than 17 years old at the point of registration;
  • The pleasure craft must not be constructed of wooden hulls;
  • The pleasure craft must not be used as a passenger ship (i.e. the craft cannot carry more than 12 passengers); and
  • The pleasure craft must not be constructed of inflatable design (including an inflatable craft with a rigid board

Name of Pleasure Craft

Craft bearing undesirable names which are likely to cause confusion in an emergency will not be registered. The owner must be prepared to change the craft's name should there be an existing one in the Register. No two craft should bear the same name.

Registration and Renewal

New Registrations : If your craft meets the above conditions, please submit the following documents (if available) for our assessment for new registrations, change of ownership or re-flag application:

  • Application form (as attached);
  • Full coloured photographs displaying the name of craft and its enclosed deck;
  • For Singapore individual, to produce NRIC. For foreigners who are ordinarily residing in Singapore, to produce passport/ work permit/ S Pass as well as official documents that provides proof of address (such as utility bills or bank/credit card statements issued to the applicant’s name)
  • For Business entities, to submit Accounting and Corporate Regulatory Authority (ACRA) Business Profile 
  • Proof of ownership of craft (Bill of Sale, Builder’s Certificate, Proof of Receipt);
  • Policy of insurance held by the owner of the pleasure craft with respect to the use or navigation of the pleasure craft;
  • Evidence of closure of foreign registry from former flag registry, such as Deletion Certificate or transcript showing closure of flag registry (where applicable);
  • Document setting out the carrying capacity, gross tonnage and specifications of the craft; and
  • Survey report by accredited organisations

Renewal : Please submit the application form, valid insurance certificate, as well as the registration documents above, if any of the documents above have not been previously submitted.

Period of Registration

The registration is valid for a  period of up to one year and will expire on the day before the anniversary date of the completion of the relevant survey. Please see example below:

Craft is SZ-licensed + SG-registered craft; Initial Registration: 15 July 2020

Initial Survey: 5 July 2020 (valid for 3 years); COR validity: 15 July 2020 to 4 July 2021. 

 ^Date adjusted to re-align with the inspection date 

  • Assuming the initial inspection was carried out on 5 Jul 2020, the craft has to undergo a renewal survey within 3 months window period from 5 Jul 2023 (expiry of initial survey), i.e. 4 Apr – 4 Jul 2023. 
  • If the subsequent renewal survey is carried out on 1 Jun 2023 (during window period), there will be no change in the COR anniversary date. If carried out outside of window period, there will be a shift in the COR anniversary to align with the anniversary date of the latest survey report.
  • If the survey is carried out after the expiry date of the COR, the registry of the craft will be closed. Should the owner wish to maintain the craft registry with us, the craft need to be registered again and comply with new registration requirements. New registration fees will be applicable, i.e. $200.

Registration Fees

The fee for initial registration and change of ownership is S$200. The fee for subsequent annual renewal is S$50. Owners are not liable for the payment of annual tonnage tax. 

Change of Ownership or Craft Particulars

The registered owner must notify the Registrar in writing, not later than 30 days after the change and produce the Certificate of Registry to him. If there is a change in ownership, the new owner must meet the eligibility requirement and submit the completed application form. 

Obligations

The owner shall ensure that within one month from the date of registration, the pleasure craft is properly marked as follows:

  • The name of the craft is clearly painted on or affixed to the bow and stern of the craft.
  • The word "SINGAPORE" is clearly painted on or affixed to the stern immediately below the name of the craft.
  • The markings must be effectively maintained and renewed when necessary during the period of registry.

Survey as part of Safety Requirements

All Singapore-registered pleasure craft must be surveyed once every 3 years according to the safety equipment requirements. The full sets of requirements are extracted in the  Second and Third Schedule of the Merchant Shipping (Pleasure Craft) Regulations . The information is also available in Annex A of  Shipping Circular No 7 of 2020 . Valid survey report to be submitted for the registration and renewal applications.

Who to Conduct Survey

Surveys of Singapore-registered pleasure craft must be conducted by recognised surveyors employed by accredited organisations (AOs).

The requirements to be an accredited organisation to survey Singapore-registered pleasure craft in accordance with Merchant Shipping (Pleasure Craft) Regulations 2020 are as follows:

  • ACRA of company
  • Professional indemnity insurance (coverage of more than S$50,000)
  • Name & NRIC (or passport/pass holder) of the surveyor (s) employed by your company
  • Class 1 Certificate of Competency (Deck or Engine Foreign-going)   or
  • Qualification from an Institution recognised in a maritime related field with specialised training (e.g Naval Architects)
  • Overseas Presence / Remote survey capabilities (new requirement for next review of AOs)

The surveyors from AOs will be required to undergo a Train-the-trainer programme conducted by MPA surveyors before the Letter of Agreement will be issued to the AOs. SRS Pleasure Craft Survey Checklist will be used in the survey by the AOs. 

Reporting of Incidents

The owner, master or the person-in-charge of a Singapore-registered pleasure craft must report to the Director of Marine immediately or, at the latest, within 2 hours of any of the following occurrences: 

  • Breaking-up, damage or loss of the craft;
  • Collision, accident, or other incident causing the breaking-up, damage or loss of the craft;
  • Accident, damage, pollution, injury or loss of life which the craft has caused or which occurs on board the craft from any other cause. 

The initial reporting can be sent via email to [email protected] or verbally over the phone via the SRS Hotline at +65 6225 5777 (6-CALL-SRS). A full report must be subsequently made to the Director of Marine, MPA, within 24 hours of the event. Please refer to Shipping Circular 08 of 2023 on Reporting of Incidents Involving Singapore-registered Ships, and submit the report to [email protected]

Closure of Registry

The registered owner must notify the Registrar in writing and surrender the Certificate of Registry.

Iconic 'little blue boat' that calls Montrose Bay home up for sale after family makes tough decision

For almost 50 years a little blue boat has been moored on the River Derwent in Hobart's northern suburbs by the side of a busy highway.

It is known affectionately by many Tasmanians as "the little blue boat", and has floated alone next to the Brooker Highway at Montrose Bay over the decades.

Sea Breeze, its official name, was built by Robin Attrill in his Montrose backyard in the early 1970s.

His son Colin Attrill said the boat was launched at Macquarie Wharf in 1976.

"It's been on the mooring in Montrose Bay ever since, and that's why it's such an iconic little blue boat," he said.

Tasmanians curious about 'little blue boat'

The boat is an object of fascination for Brooker Highway motorists and foreshore walkers due to it seemingly never moving.

Colin Attrill said it was "absolutely amazing" the number of people who would stop and talk to him about the boat when he was launching the dinghy to go and check on it.

"The number of people that talk to me that are walking past and go 'that boat has been there forever' and 'it was there when I was going to school or every day when I've been driving to work'," he said.

"Some people say they've never seen it move. Well it used to move all the time.

"Of late it's slowed up, we're all busy and dad has slowed up. We lost mum and once that happened it impacted on family activities."

Tough decision to sell

Its owner is now 91 and the boat has not been sailed for about 10 years.

Colin Attrill said the family had recently made the tough decision to try to sell the boat.

"Dad isn't well and he's gotten old, which we all do, and the boat's got old," he said.

"Anyone who knows about a timber boat knows that they need maintenance."

Mr Attrill said the family used to put the boat on the slip at least once a year to clean and antifoul it, and do any repairs.

"But the past few years Dad has been unable to do anything, and the boat unfortunately has just sat on the mooring," he said.

He said the family decided it was time for the boat to have a new owner.

"Nobody is using it, it needs a new owner who will give it the time and get the enjoyment out of it that we had growing up," he said.

"It's a great boat, and there are many years left. Wooden boats just last."

'Next phase' for the boat

The Attrill family is full of passionate sailors and Robin's brother Peter represented Australia in sailing at the Helsinki Olympics in 1952 — Tasmania's fifth Olympian and the first to represent the state in sailing.

When Robin finished building the 25-foot river cruiser, known by the family as The Breeze, it was used for trips away around Hobart.

"We used to have family trips down the channel, down to Cygnet, down to Dover, and all places in between fishing and weekends away," he said.

"We also used to go to events in Hobart like the Hobart Regatta, the Sandy Bay Regatta. We'd be down the river at any chance, or up the river. She made it to New Norfolk a couple of times.

"The boat was all over the place, wherever we could."

Mr Attrill said it would be a sad day when the boat left Montrose Bay after almost 50 years.

"We will see where it goes and where it ends up and what's the next phase for the boat," he said.

Over the years its owner has been keeping a watchful eye on it just a matter of metres away, across the Brooker Highway from his Montrose home of more than 70 years.

"He's always been there. He'd open the blinds in the morning in the kitchen and look out the window and there's the boat," son Colin said.

"It's always been a part of his life."

The owner of a $3.4 million Lamborghini yacht threatened a private dock employee after being told he couldn't be there, the San Diego-based broadcaster CBS8 reported on March 11.

Joseph Holt, a 21-year-old employee at Marriot Marina in San Diego, told CBS8 that he spotted the yacht sailing into the private dock. The owner, whom CBS8 identified as Ajay Thakore, tried to pick another person up at the dock, Holt said.

"I told him respectfully that he couldn't be there, and I honestly was hoping to have a conversation with him about his cool boat," Holt told CBS8.

In a YouTube video posted by @SM-wc9eq on March 10, a dark blue Tecnomar for Lamborghini 63 is seen sailing out of a dock. A man in a gray T-shirt, a pair of jeans, and a cap was shown standing on the yacht. The man appeared to be Thakore, per CBS8.

Thakore was shown shouting at Holt. "I will kill you, you know I will kill you!" he can be heard saying multiple times in the video

Thakore was later shown pounding his fist on his palm and pointing his thumb down before telling Holt: "To your face!" Holt was shown responding by pointing his middle finger at Thakore.

"I really was trying to restrain myself from getting fired from my job or stepping out of line. The only thing I did was give him the bird," Holt told CBS8.

Holt said Thakore then took $100 bills from his wallet and threw them at him. He added that Thakore mooned him. This exchange was not shown in the video.

"He was saying I'm nobody, I'm nothing, I work a silly job. He said that he knows people, he has connections, he can change my life and ruin it," Holt said. Holt did not immediately respond to Business Insider's request for comment.

The San Diego Harbor Police arrived at the marina 10 minutes after Thakore's yacht exited the dock, per CBS8.

The Harbor Police told Business Insider that Holt decided to press charges against Thakore and that they are investigating the incident.

According to Thakore's LinkedIn page , he's the CEO of Doctor Multimedia. The company's website shows that it's a healthcare marketing firm based in San Diego. Thakore appears to go by the name Ace Rogers on Instagram and TikTok, where he's noted as being a professional gambler.

Thakore, through his public relations team, told CBS8 in a statement that his altercation with Holt was "regrettable."

"What started as a minor misunderstanding escalated into an argument, and I apologize for my actions and to those who witnessed the unfortunate exchange," the statement said. Thakore did not immediately respond to a request for comment from BI.

Thakore isn't the only CEO who's been called out for threatening another person. In November 2021, an Activision spokesperson told BI that its ex-CEO Bobby Kotick had previously apologized for telling his assistant he would have her killed. The spokesperson added that Kotick's threat was "obviously hyperbolic and inappropriate" and that "he deeply regrets the exaggeration and tone."

In June 2020, Lisa Alexander, the CEO of LaFace Skincare, a cosmetics company, apologized in a statement to the media after she had threatened to call the police on her neighbor for writing "Black Lives Matter" on his property. Alexander said in the apology that she was "disrespectful" and "should have minded my own business."
